Welcome! These Terms of Service ("Terms") are a legal agreement between you and Faith Over Fear Nurse LLC, a [Virginia] limited liability company ("Faith Over Fear Nurse," "we," "us" or "our"). They apply when you visit faithoverfearnurse.com (the "Site") or buy or use any of our programs, courses, products, coaching or services (our "Services"). By using the Site or our Services, you agree to these Terms. If you don't agree, please don't use them. These Terms replace all earlier versions.

1. Who can use our Site

You must be at least 18 years old to use our Site and Services. By using them, you confirm that you are 18 or older and able to enter into a binding agreement where you live.

2. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. If you keep using the Site or our Services after an update, you accept the new Terms, so please check this page now and then.

3. Your account

Some of our Services need an account. When you create one, please give us accurate, current information and keep it up to date. Keep your login private: you're responsible for everything that happens under your account, and you can't share it with or transfer it to anyone else. Let us know right away if you think someone has used your account without permission. If you give us false information, we may suspend or close your account.

4. Purchases, payments and refunds

Prices are listed on each product's page and are charged in U.S. dollars. Payments are processed by our payment providers, such as Stripe or Circle. Payment plans through Affirm, Klarna or Afterpay are agreements between you and that provider.

Digital products and courses (such as the Scrubs to Screens Starter System): all sales are final and no refunds will be issued due to the digital nature of the products.

Coaching programs (such as STAT Level and Beyond the Badge): all sales are final and no refunds will be issued due to the digital nature of the products and 1:1 coaching.

Services (such as Resume Revamp and power hours): all sales are final and no refunds will be issued due to the digital nature of the products and 1:1 coaching.

If you choose a payment plan we offer directly, you agree to complete every payment, even if you stop taking part in the program. No charge backs accepted. 

Remote Rounds is covered by its own Remote Rounds Terms at app.faithoverfearnurse.com/terms, including its refund policy.

5. Coaching, live calls and community

Live calls and our community include other members. Please keep what other members share private, and don't record, screenshot or share anyone else's information without their permission. Live calls may be recorded and shared with members of the same program, so you can catch up if you miss one.

We may remove anyone from a program or community for harassment, for sharing program materials outside the program, or for other behavior that harms other members, without a refund.

6. Educational only, and no guarantees

Our coaching, courses, content and tools are educational. They are not medical, legal, financial or mental health services. We can't guarantee interviews, job offers, a specific salary, income or any other result. Your results depend on your experience, your effort, the job market and many other things outside our control. Please also read our General Disclaimer.

7. How you can and can't use our Site and Services

Please use our Site and Services legally and kindly. You agree not to:

• break any law, or use our Site or Services for anything illegal or unauthorized

• post or send anything unlawful, threatening, harassing, hateful, defamatory, obscene, or invasive of someone else's privacy

• harm minors in any way

• pretend to be someone else, or misrepresent who you're connected to

• post or share anything you don't have the right to share, including someone else's copyrighted work or trademarks

• send spam, junk mail or unauthorized advertising

• upload viruses or any code meant to damage or interfere with software, hardware or our Site

• disrupt other members' ability to take part, or interfere with our Site, servers or networks

• stalk or harass anyone, or collect or store other members' personal information

• get around any security feature, or access our Services any way other than the ones we provide

We may review, refuse or remove any content that breaks these Terms or that we find offensive, and we may suspend or close accounts that break them. We may also keep or share account information when the law requires it, or when we believe in good faith that it's needed to enforce these Terms, answer a legal claim, respond to a support request, or protect the rights and safety of Faith Over Fear Nurse, our members or the public.

8. Our content and intellectual property

Everything we create, including our videos, trainings, workbooks, templates, roadmaps, custom GPTs, tools, text, graphics and our name and logo, belongs to Faith Over Fear Nurse LLC or the people who licensed it to us, and is protected by copyright, trademark and other laws.

When you buy or join something, you get a personal, non-transferable right to use it for your own career or business. You may not copy, share, resell, publish, give away or make your own products from our content, or share your login, without our written permission. You may not use the Faith Over Fear Nurse name, logo or brand without our written permission.

9. Your content and your feedback

You own what you post or share with us. By posting it in a program or community, you give us permission to host and display it there so we can run our Services. This permission ends when you leave that program or community.

If you send us ideas, suggestions or feedback about our Services, please don't include anything confidential. We may use your ideas freely, without owing you anything for them.

10. Other websites and tools

Our Site and Services link to and use other companies' websites and tools, such as Circle, Stripe, Zoom and Flodesk. Their own terms and privacy policies apply when you use them. We don't control them and aren't responsible for their content, products or availability. Some of our links are affiliate links, which means we may earn a commission if you buy through them. See our General Disclaimer for more.

11. Ending your access

You can close your account anytime by emailing us at allissa@faithoverfearnurse.com. Section 4 explains what happens with anything you've paid for.

We may suspend, limit or end your access, without notice, if you break these Terms, if law enforcement or a government agency asks us to, if we change or discontinue a Service, because of unexpected technical or security problems, after a long period of inactivity, if you take part in fraud or illegal activity, or if you don't pay what you owe. When your access ends, you may lose access to your account and anything inside it. We aren't liable to you or anyone else for ending access as described here.

12. Changes to our Services

We may change, pause or discontinue any part of our Site or Services at any time, with or without notice. We aren't liable to you or anyone else for those changes.

13. Mistakes on our Site

We work hard to keep our Site accurate, but sometimes it may contain typos or mistakes in descriptions, pricing, promotions or availability. We may correct them at any time, and we may cancel an order that was based on a mistake, even after you've placed it.

14. No warranties

Our Site and Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that our Site or Services will meet your needs, will be uninterrupted, timely, secure or error-free, that any results will be accurate or reliable, or that any errors will be fixed. Anything you download or get through our Services is at your own risk. No advice or information you get from us creates a warranty unless it's written in these Terms.

15. Limits on our liability

To the fullest extent allowed by law, Faith Over Fear Nurse LLC and its owners, employees, contractors, partners and licensors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost data or loss of goodwill, that come from your use of, or inability to use, our Site or Services; the cost of replacement goods or services; unauthorized access to or changes to your data; anything a third party says or does on our Services; or any other matter related to our Site or Services, even if we were told such damages were possible.

16. Your responsibility to us

You agree to defend, protect and hold harmless Faith Over Fear Nurse LLC and its owners, employees, contractors, partners and licensors from any claim or demand, including reasonable attorney's fees, made by anyone because of content you post or share, your use of our Services, your breaking these Terms, or your violating someone else's rights.

17. Copyright complaints

We respect other people's intellectual property, and we ask our members to do the same. If you believe something on our Site infringes your copyright or other intellectual property, email our Copyright Agent at [your email] with:

• your physical or electronic signature, as the owner or someone authorized to act for the owner

• a description of the work you believe was infringed

• where on our Site the material is

• your address, phone number and email

• a statement that you believe in good faith the use isn't authorized by the owner, its agent or the law

• a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner

We may disable or close the accounts of anyone who infringes others' rights.

18. Notices

We may send you notices, including notices about changes to these Terms, by email, text message, mail or by posting them on our Site. Service, administrative and legal notices are part of using our Services, so you can't opt out of them.

19. Which law applies, and deadlines for claims

These Terms, and anything related to them or to your relationship with us, are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any claim or dispute must be brought in the courts with jurisdiction in York County, Virginia, or in the U.S. District Court for that area, and you and we both agree to those courts' jurisdiction. Any claim related to our Site, Services or these Terms must be filed within 2 years after it arose, or it is permanently barred.

20. Government requests

To follow the law, respond to subpoenas or court orders, protect our systems, or keep our business running safely, we may access and share information we consider necessary, including your information, IP address and usage history, as described in our Privacy Policy.

21. Using our Site outside the United States

Our Site is run from the United States. If you use it from another country, you're responsible for following your local laws, and you agree not to use our content anywhere or in any way the law doesn't allow.

22. Privacy

How we collect and use your information is explained in our Privacy Policy at faithoverfearnurse.com/privacy-policy. By using our Services, you agree to it, including your information being stored and processed in the United States.

23. The fine print

These Terms, together with our Privacy Policy, our General Disclaimer and any terms for a specific product (like the Remote Rounds Terms), are the entire agreement between you and us. If a product's own terms conflict with these, the product's terms apply to that product. If any part of these Terms can't be enforced, the rest still applies, and the court should give effect to what that part was meant to do. If we don't enforce a part of these Terms right away, we can still enforce it later. Your account and your rights under these Terms can't be transferred to anyone else.
